The I-526 Petition will be approved only if USCIS is satisfied that the foregoing criteria have been met. The determination of whether these criteria have been established is within the discretion of USCIS. It is also within the power of USCIS to seek information about other aspects of the investment and the relationship of the investor to the enterprise. Approval of the I-526 Petition by USCIS means that the foreign investor, their spouse and children under the age of 21 years may become conditional lawful permanent residents (obtain temporary “Green Cards”) for a two year period. Approval of the I-526 Petition does not mean that the investor has been granted admission to the United States as a permanent resident. The application for admission as a permanent resident is a separate process which happens after the two years of temporary residence as specified above.
